1. Acceptance of Terms

By renting a bike or scooter from Jolly Auto and Rental Bike, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

2. Eligibility and Requirements

To rent a vehicle from us, you must meet the following criteria:

• Be at least 18 years of age or older
• Possess a valid driver's license appropriate for the vehicle category
• Provide valid government-issued identification
• Have a valid credit/debit card or sufficient deposit for payment
• Not be under the influence of alcohol, drugs, or any substance that impairs driving ability

We reserve the right to refuse service to anyone who does not meet these requirements or appears to be unfit to operate a vehicle safely.

3. Rental Agreement and Booking

All rentals are subject to availability and confirmation. When you book a vehicle:

• You enter into a legally binding rental agreement with Jolly Auto and Rental Bike
• You agree to pay all applicable fees, including rental charges, security deposits, and any additional charges
• You must provide accurate and complete information during the booking process
• Bookings can be made online, via phone, or in person at our location
• Confirmation of your booking will be sent via email or SMS

4. Payment Terms

Payment for rentals must be made according to the following terms:

• Security Deposit: A refundable security deposit is required at the time of rental
• Rental Fees: Calculated based on the rental period (hourly, daily, or weekly rates)
• Payment Methods: We accept credit cards, debit cards, UPI, and cash (where applicable)
• Late Fees: Additional charges apply if the vehicle is returned late without prior authorization
• Fuel Policy: Vehicles should be returned with the same fuel level as provided
• Additional Charges: May include damage fees, cleaning fees, traffic violations, and toll charges

5. Vehicle Use and Restrictions

When using our vehicles, you agree to the following restrictions:

• Use the vehicle only for lawful purposes and in accordance with all traffic laws
• Not use the vehicle for racing, rallying, or any competitive events
• Not allow anyone other than the authorized renter to operate the vehicle without prior approval
• Not transport more passengers than the vehicle's capacity allows
• Not use the vehicle for commercial purposes (e.g., taxi services, deliveries) unless explicitly authorized
• Not drive under the influence of alcohol, drugs, or any impairing substances
• Not modify, alter, or tamper with the vehicle in any way
• Not take the vehicle outside the permitted geographical area without authorization

6. Vehicle Condition and Inspection

Before taking possession of a rental vehicle:

• You must inspect the vehicle and report any existing damage or defects
• Take photos or videos of the vehicle's condition for your records
• Ensure all safety equipment (helmet, lights, brakes) is in working order
• Report any concerns immediately to our staff

You are responsible for maintaining the vehicle in good condition during the rental period, including regular checks of tire pressure, oil levels, and other essential components.

7. Insurance and Liability

Insurance coverage and liability terms:

• Basic Insurance: All vehicles come with basic third-party insurance coverage
• Optional Coverage: Additional insurance packages are available for comprehensive protection
• Renter Liability: You are responsible for any damage to the vehicle during the rental period
• Theft or Loss: In case of theft or total loss, you may be liable up to the vehicle's full value
• Personal Injury: We are not liable for personal injuries sustained during the rental period
• Third-Party Claims: You are responsible for any claims made by third parties arising from your use of the vehicle

8. Accidents and Breakdowns

In the event of an accident, breakdown, or vehicle damage:

• Immediately contact Jolly Auto and Rental Bike customer support
• File a police report if required by law or if significant damage has occurred
• Do not admit fault or make any statements that could be interpreted as an admission of liability
• Provide all necessary documentation and cooperate with insurance procedures
• Do not attempt unauthorized repairs; contact our support team for assistance
• You may be responsible for repair costs, towing fees, and loss of rental income

9. Cancellation and Refund Policy

Our cancellation and refund policy is as follows:

• Cancellation by Customer: Cancellations made 24 hours before rental start time receive a full refund
• Late Cancellations: Cancellations within 24 hours may incur a cancellation fee of up to 50%
• No-Show: Failure to pick up the vehicle without cancellation results in forfeiture of all payments
• Early Return: No refunds are provided for early returns unless due to vehicle malfunction
• Cancellation by Company: We reserve the right to cancel bookings due to vehicle unavailability, with full refund

10. Traffic Violations and Fines

You are solely responsible for:

• All traffic violations, parking tickets, and fines incurred during the rental period
• Payment of all penalties, including any administrative fees we may incur
• Toll charges, congestion charges, and similar fees
• Any legal consequences arising from violations of traffic laws

We reserve the right to charge your payment method for any unpaid fines, plus an administrative processing fee.

11. Data Protection and Privacy

We collect and process your personal data in accordance with our Privacy Policy. By using our services:

• You consent to the collection and processing of your personal information
• Your data may be used for rental verification, payment processing, and customer service
• We implement security measures to protect your information
• You have rights regarding your personal data, including access, correction, and deletion

12. Termination of Rental

We reserve the right to terminate your rental immediately if:

• You breach any of these Terms and Conditions
• You provide false or misleading information
• The vehicle is used for illegal purposes
• Payment is not received or is fraudulent
• You are deemed unfit to operate the vehicle safely

Termination does not relieve you of your financial obligations or liability for any damages incurred.

13. Limitation of Liability

To the fullest extent permitted by law:

• Jolly Auto and Rental Bike is not liable for indirect, incidental, or consequential damages
• We are not responsible for personal injury, property damage, or loss of personal belongings
• Our total liability is limited to the amount paid for the rental
• We do not guarantee uninterrupted or error-free service

14. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government actions, pandemics, or other events classified as force majeure.

15. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website or app. Your continued use of our services after such modifications constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

16. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the jurisdiction in which Jolly Auto and Rental Bike operates. Any disputes arising from these terms or your use of our services shall be resolved through:

• First, good faith negotiations between the parties
• If unresolved, through binding arbitration in accordance with local arbitration rules
• The courts of our jurisdiction shall have exclusive jurisdiction over any legal proceedings
